Thank you for choosing eConSellerz LLC. By visiting our site or purchasing our goods or services, you agree to comply with these terms and conditions and our privacy policy even if by accessing and using our website and services a purchase is not made. In these terms and conditions, the term "website" refers to the eConSellerz LLC website, "we," "us," "our," and "eConSellerz LLC" refers to eConSellerz LLC, and "you," "client," "buyer," and "user" refers to you, the user and client of eConSellerz LLC. 

Please read these terms and conditions carefully before using or obtaining any information or service from eConSellerz LLC. These terms and conditions apply to all versions of eConSellerz LLC and eConSellerz.com or its subsidiary websites, including the mobile and tablet versions, accessible through desktop, mobile, tablet, social media, or other devices. 

1. ACCEPTANCE OF TERMS 

If you are under 18 years of age, please refrain from providing any personal information about yourself to eConSellerz LLC. Parents and legal guardians are responsible for determining whether the content and services offered on the website are suitable for their children or minors under their guardianship.  

eConSellerz LLC reserves the right, at its sole discretion, to deny its services to any user or entity and modify its eligibility criteria at any time. However, this provision is void where prohibited by law. In such jurisdictions, the right to access the service and the website is revoked.  

To use the website and services, you must comply with these terms and all applicable local, state, national, and international laws, rules, and regulations. By using the website and services, you represent and warrant that you have the complete right, power, and authority to enter into this agreement and to fulfill all your obligations under these terms. Furthermore, you represent and warrant that you are not under any legal disability or contractual restriction that prevents you from entering into this agreement. 

2. NOTIFICATIONS AND NEWSLETTER 

Thank you for providing your email address and telephone number to eConSellerz LLC. By doing so, you agree to receive important notifications, communications, news, and special content from us via email. If you do not wish to receive these emails, you may opt out at any time by informing us through our contact information in the emails. Please remember that opting out may prevent you from receiving important news, updates, and special content about our services. 

3. eConSellerz LLC 

eConSellerz LLC is a wholesaler and distributor of a wide range of general merchandise, including Smart Home, Home, Garden & Tools, Pet Supplies, Food & Grocery, Beauty & Health, Toys, Kids & Baby, Sports, Outdoors, Automotive, Industrial and more. We carry a wide range of brands and categories. eConSellerz LLC does not claim to be authorized distributors of any brands or merchandise we carry or offer unless specifically stated. 

Much of the merchandise we offer customers is in stock and in our warehouse; however, we sometimes offer products that are currently on backorder and/or en route to our warehouse.  

4. ORDERS 

All purchase orders, emails, and verbal agreements are legally binding. Cancellations are not permitted. Failure to pay may result in further legal action by eConSellerz LLC including but not limited to the responsibility to pay legal fees/costs for collection and the buyer is obligated to pay all litigation fees under the jurisdiction of the State of California.  

Upon receiving an order inquiry, eConSellerz LLC will send a confirmation email that includes a sales order outlining the order details. The customer can then choose a payment method and make the payment in full. Once the payment has been received, we will provide the customer with an invoice. All sales are final, and no changes are permitted after receiving receipt of a purchase order or payment. 

eConSellerz LLC does not provide any supporting documents in addition to invoices for any third-party marketplace issues, including but not limited to Amazon.  

eConSellerz LLC reserves the right to limit the number of units purchased by each customer and may also restrict sales of products in specific regions or jurisdictions. eConSellerz LLC may cancel any order, withhold products, and may change or discontinue the availability of products at any time at its sole discretion. eConSellerz LLC reserves the right to refuse or cancel any order placed by the customer.  

5. IN-HOUSE PREPPING 

• $0.25 - Per FNSKU Label (Amazon FBA) 
• $0.25 - Bundling (Per UPC)  
• $0.25 - Polybagging (Per UPC) 

6. PRICES 

Please note that all prices, discounts, and promotions displayed are subject to change without notice. The price you will be charged for a product or service will be the price that is advertised at the time of purchase. This is subject to the terms of any promotions or discounts that may be applicable. The final price, including taxes and shipping charges, will be displayed during checkout and provided in the order confirmation email.  

7. PAYMENTS 

Merchandise will be paid through the following payment methods: 

• Bank wire transfers (fees may apply) 
• Credit/debit card (fees apply)  
• Zelle (no fee) 

Payment terms are at our sole discretion; all payments are due in full at the time of purchase upon receiving a sales order. 

For credit/debit card payments, you represent and warrant that (i) the credit card information you provide to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) the charges you incur will be accepted by your credit card company, and (iv) you will pay the charges you incur at the advertised prices, including shipping and handling and all applicable taxes. If you choose to make payments by credit card, additional charges apply. 

The sales order must be paid in full before the merchandise being shipped/picked up. Payment will be charged through the payment method selected by the customer. Once a transaction is processed and the payment process is completed, an invoice will be sent to the email address provided by the customer. 

If your payment is declined, you will not be charged, and the order will not be processed. You must provide an alternative payment method to complete the order. 

8. PRODUCT DESCRIPTIONS 

At eConSellerz LLC, we are committed to providing accurate product descriptions.  

9. SHIPPING AND DELIVERY 

Upon payment, the customer may select free pick-up or prepaid shipping. We do not offer free shipping. Shipping costs will be confirmed when an order request is placed. Therefore, the buyer is responsible for freight charges. The buyer bears the cost of the shipment and owns the goods in transit. If you opt for shipping, the cost will be included in the sales order after providing the shipping address.
We are not responsible for delays and/or any damage that may occur in transit. Shipping and delivery dates are estimates only and cannot be guaranteed.  

Domestic Shipping
We offer shipping services to customers nationwide.

Fast Delivery
Our priority is to process orders and get packages to their destination as quickly as possible. We offer a variety of delivery options to meet your needs.  

10. STORAGE 

All orders must be picked up within 3 business days of receiving an invoice indicating the order is paid for in full. After 3 days, the buyer will be subject to pay a storage fee of $150.00 per UPC per day.  

11. RETURNS AND REFUNDS 

Please be aware that all orders are final and non-refundable. We do not accept any returns under any circumstances. Once an order has been confirmed, it cannot be canceled, modified, or exchanged. 

12. MANUFACTURER'S WARRANTY AND DISCLAIMER. 

(a) We do not manufacture or produce any of the merchandise offered on our website. The availability of merchandise through our website/emails does not indicate an affiliation with or endorsement of any product, service, or manufacturer. To obtain warranty service for defective merchandise, please follow the instructions included in the manufacturer's warranty.
(b) All products and services offered on this site and email communications are provided "as is" without warranty of any kind, including, without limitation, any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; or (c) warranty against infringement of the intellectual property rights of a third party; whether express or implied by statute, course of dealing, course of performance, usage of trade, or otherwise.
(c) You affirm that we will not be liable, under any circumstances, for any claim or breach of warranty for any damage that resulted from the failure of the manufacturer to fulfill its warranty obligations to you. 

13. DISCLAIMER 

eConSellerz LLC is not responsible for any items that are prohibited for sale on Amazon and/or FBA, or any other marketplace. The buyer is responsible for ensuring their eligibility to sell these products before making a purchase. We do not claim to be authorized resellers or distributors of any of the brands we offer unless otherwise stated. Our items may or may not be purchased from manufacturers, distributors, wholesalers, or liquidators. We do not claim any intellectual property. All copyrights and intellectual properties belong to their respective owners. Additionally, we are not responsible for any items that are or become prohibited after the sale. This includes, but is not limited to, trademarks, categories, subcategories, PPE, hazardous materials, IP claims, pesticides, limited storage, flammables, policy changes, or listing closures. We are not liable for any Amazon or brand-related issues, nor can we manage price fluctuations within Amazon or any other marketplace.

14. COPYRIGHT 

All materials found on www.econsellerz.com, including but not limited to names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software, and other elements, are protected by copyrights, trademarks, and/or other intellectual property rights. These rights are neither owned nor controlled by eConSellerz LLC or third parties that have licensed or otherwise provided their material to the website. 

15. COPYRIGHT INFRINGEMENT (DMCA) 

eConSellerz LLC takes all inquiries, complaints, and claims related to alleged infringements of the Digital Millennium Copyright Act (DMCA) seriously and will respond to them promptly. eConSellerz LLC values and respects the intellectual property rights of others. If you believe any material provided on or in connection with our website violates your copyright or any other intellectual property right, please send us your copyright infringement request pursuant to Section 512 of the DMCA. You can contact us using the information provided below and include the following information in your request: 

• Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers or a statement regarding ownership of the work should be included.

Any personal information provided to eConSellerz LLC during the use of the website will remain confidential and be used in accordance with our privacy policy. By using our services, you are aware and agree that we may collect and store your personal information.  

18. PROHIBITED ACTIVITIES 

The website contains various content and information, including data, text, photos, graphics, videos, and maps. This content and the infrastructure used are owned by eConSellerz LLC or licensed by third parties. You are not allowed to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, or services obtained from or through the website.  Additionally, the following activities are prohibited: 

• Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy, or otherwise exploit any content of the services, including but not limited to, using any robot, spider, scraper, or other automated means, including Artificial Intelligence (AI) or any manual process for any purpose not in accordance with this agreement. 
• Violate the restrictions in any robot exclusion headers on the services or bypass or circumvent other measures employed to prevent or limit access to the services. 
• Take any action that imposes, or may impose, at our discretion, an unreasonable or disproportionately large load on our infrastructure. 
• Deep-link to any portion of the services. 
• "Frame", "mirror" or otherwise incorporate any part of the website into any other websites or service. 
• Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by eConSellerz LLC in connection with the services. 
• Circumvent, disable, or otherwise interfere with security-related features of the website or features that prevent or restrict the use or copying of any content. 
• Download any content unless it’s expressly made available for download by eConSellerz LLC. 

19. INDEMNIFICATION 

By accepting these terms, you agree to protect and compensate eConSellerz LLC against any legal claims, damages, penalties, or other expenses arising from third-party actions. This includes covering all reasonable legal and accounting fees associated with defending against such claims: 

• Your breach of this agreement or the documents referenced herein. 
• Your violation of any law or the rights of a third party. 
• Your use of the services. 

20. CHANGES AND TERMINATION 

We may modify the website and these terms at any time, at our sole discretion and without notice. You are responsible for keeping yourself informed of these terms. Your continued use of the website constitutes your acceptance of any changes to these terms, and any changes will supersede all previous versions of the terms. Unless otherwise specified, all changes to these terms apply to all users and clients. In addition, we may terminate our agreement with you under these terms at any time by notifying you in writing or without notice. 

21. ASSIGNMENT 

This agreement is non-transferable to any other parties.  

22. NO PARTNERSHIP 

You agree that no joint venture, partnership, employment, or agency relationship exists between you and eConSellerz LLC because of these terms or your use of the services. 

23. INTEGRATION CLAUSE 

This agreement, the privacy policy, and other legal notices published by eConSellerz LLC constitute the entire agreement governing your use of the website and services. 

24. DISPUTES 

The user agrees that any dispute, claim, or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation, or validity thereof or the use of the services, shall be resolved as follows: 

First, you agree to initiate a formal dispute proceeding by communicating through our contact information. eConSellerz LLC may send you a written offer after receiving your initial communication. If you are offered a settlement, and you do not accept the offer, or we are unable to resolve your dispute satisfactorily, and you wish to continue with the dispute process, you must initiate the dispute resolution process as follows: 

If the dispute can’t be resolved within 30 days between the parties as to any of the terms and conditions of this agreement, or a Breach thereof, the parties agree to designate a retired Judge or an Attorney as a Mediator through either ADR or JAMS, or Signature Resolution. The cost is to be split equally between the parties. If the matter cannot be resolved by mediation, then the parties agree to appoint a retired Judge to conduct an arbitration which shall be binding upon all parties as to all Issues, with the costs and fees including attorney fees to be determined by the arbitrator. eConSellerz LLC may, at its sole discretion, file a lawsuit, if it deems it to be in the best interest of the company. 

To the fullest extent permitted by law, you agree that you will not file, join, or participate in any class action lawsuit concerning any claim, dispute, or controversy that may arise in connection with your use of the website and services. 

The courts of the United States, specifically the courts located in the State of California, shall have jurisdiction over any dispute, controversy, or claim relating to eConSellerz LLC and its business operations.  

25. FINAL PROVISIONS 

These terms and conditions are governed by the laws of the United States. Use of the website and services are not authorized in any jurisdiction that does not give effect to all of the provisions of these terms.
Our performance of these terms is subject to existing laws and legal processes, and nothing contained in these terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of our website or information provided to or gathered by us with respect to such use.
If any part of these terms is found invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected or impaired. Our failure or delay in enforcing any provision of these terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.
Any rights not expressly granted herein are reserved. 

26. PRODUCTS 

All online marketplace retailers including Amazon/FBA, eBay, and Walmart. 

Please ensure you are aware of any restrictions imposed by your marketplace before making a purchase. Once a sale is made, it is final, and we cannot issue a refund. You are accountable if you are later restricted or gated due to brand restrictions, category restrictions, subcategory restrictions, PPE requirements, hazmat regulations, closed listings, IP complaints, or the need to provide additional forms such as CPC, lab testing, or letters of authorization. Please note that the intellectual properties of all products belong to their respective owners. We do not claim ownership of any intellectual property or copyrighted material. As a wholesale provider, we do not guarantee that the goods we offer are sourced directly from the manufacturer. Our products may come from distributors, wholesalers, liquidators, or closeout companies. It is your responsibility to research and verify that you are authorized to resell the goods you purchase. Please note that the availability, price, and quantity of our products are subject to change at any time.
